1. Scope and platform operator
These Terms of Service govern the use of Airtrde, an aircraft marketplace operated by BoMaine AG, Bahnhofstrasse 8, 6055 Alpnach, Switzerland. Airtrde connects buyers with sellers, brokers and dealers of private aircraft.
2. Listing and sale model
Sellers pay a flat listing fee per aircraft as shown on the "Sell your aircraft" page. Airtrde does not charge a commission on the sale of the aircraft. The listing fee covers the publication period and review services described at the time of purchase. All financial terms, pricing and delivery of the aircraft itself are agreed directly between buyer and seller.
3. User accounts and conduct
Users must provide accurate information, keep account credentials secure, and use the platform only for lawful purposes related to the sale or purchase of aircraft. Airtrde may suspend accounts that violate these terms or that appear to be used for fraudulent activity.
4. Content and listing accuracy
Sellers are responsible for the accuracy of listing information, images, pricing and availability. Airtrde performs a manual review before publication but does not independently verify every technical claim or legal title. Buyers should conduct their own due diligence, including pre-purchase inspection and legal review.
5. Limitation of liability
Airtrde and BoMaine AG act as an intermediary and information platform. We are not a party to any aircraft purchase, sale, financing, brokerage or charter agreement. To the extent permitted by law, our liability is limited to direct damages caused by our own gross negligence or wilful misconduct.
6. Changes and governing law
We may update these terms at any time. The current version applies at the time of use. These Terms of Service are governed by Swiss law. The place of jurisdiction is Alpnach, Switzerland, unless mandatory consumer law requires otherwise.
Final legal review by your counsel is recommended before these terms are published as binding.
